David Gordon and Richard Clark, the two Oklahoma men convicted in a $41.8-million pump-and-dump case that includes former Canadian broker Dean Sheptycki, are unfairly facing potential life sentences, their lawyers say. (All figures are in U.S. dollars.) Prosecutors have recommended that the men receive 30-year and 255-year jail terms. For Mr. Gordon, who is 48, and Mr. Clark, who is 62, the sentences would amount to life in jail, or close to it.

On April 30, 2010, an Oklahoma jury convicted the pair on charges stemming from the fraudulent promotion of four pink sheets companies. The jury found that they paid for misleading faxes and e-mails, then dumped millions of shares. The judge sent the men to jail to await sentencing, which is scheduled for Aug. 25, 2010. Now, with the sentencing date approaching, lawyers for the two men have filed presentencing memorandums, in which they plea for leniency.

Mr. Clark, who is facing a possible 255-year jail term, points out that if he were to receive such a sentence it would exceed the 150-year term that Bernie Madoff is serving. He argues that such a term is "draconian" given the nature of his crime. The government has not proven several required sentencing factors, including investor losses of over $20-million, his memorandum claims. He says he should receive up to six months, which he could do as home confinement.

What in fucks name is going on here. 255 years for a pump and dump? Yet surely if he hadn't falsely unrestricted pink-sheet stock he'd be facing nothing.

Well so much is made of pump and dumps that investors cry foul just because someone is posting how great they think a stock is. I know this case was out and out fraud but it seems there are so many junior investors who don't do any research into their investments. Some investors should have to take a course and sign a waiver to join some of the boards these days.

I don't feel sorry for them. This goes beyond a wild dream or scheme and was outright fraud. Life in jail is just right because many people that they suck in never recover. (don't feel to sorry for them either) But lock up the fraudsters for life...........they can teach the hard guys......the three R's.

Nobody gets life when you work for Goldman , lie to your client fund managers to get them to buy garbage that they pass on to the public with billions of provable losses and in a circle jerk point their fingers at each other . Why dosent the little guy get bailed out with TARP money

255 years? F me. That's insanity. This a pump and dump for crissakes, not murder or arson. Madoff only got 150 years and he bilked people out of billions and his fraud went on for 25 years. The "Justice System" has its collective head up its arse...

Nobody is getting 255 here. Stockwatch isn't reporting clearly. 30 is the recommendation for both. Of course, the real culprit of this whole thing, Mark Lindberg, is going to play golf tomorrow, have a stupidly overpriced glass of wine out of his house's wine room and hope the Mexican Josh paid to break his knee caps isn't real good with maps.

These scum were involved in many more criminal acts then are listed here. They were members of a stock cartel that stole over a 100 million collectively. If you researched their past associations and involvements you'd say 25 yrs. is too light. Wait 'till all the residual arrests are made and then connect the dots. They got off easy !
